THE BOUTIQUE THE WEATHER INTERACTIVE CAMPSA GUIDE
Citizen's rights when attending public shows
by Antonio de Lorenzo
Any person attending a public show is under legal obligation. The citizen must be aware of his rights when purchasing the entrance ticket, the norms to be followed by the spectator and the security conditions of the venue hosting the show.

Although the regulations of each Autonomous Community have their own norms when its comes to public shows, there are general regulations common to all Spanish cities.

The importance of the entrance ticket
Spectators must be aware that the entrance ticket is their fundamental guarantee that they can demand their rights in public shows. A ticket is effectively a licence which gives the holder the right to attend the show in question one time only. Any spectator who sells on their ticket is breaking the law, even if they sell it at face value.

If the show is unexpectedly cancelled or changed, the spectators have the right to a full refund unless the ticket says otherwise. In fact, on the back of open air concert tickets, the organiser usually states that bad weather conditions do not give the spectator a right to a refund even if the show is suspended halfway through for whatever reason.

Rights of the spectator
The following situations can be legally reported: if the show does not follow the conditions or timetable announced; if the entrance fees exceed those advertised to the public on posters or on the tickets themselves; if the venue lacks basic safety, hygiene or comfort norms required by the law; or any mistreatment or infringement against the spectator's basic rights.

The spectators can state any objections they may have in the book of complaints, previously showing their national identity document, if they consider an infringement has occurred during the show under the governing state or autonomous community laws.
The access to venue hosting public events also includes the consent to be photographed or filmed, without right to any compensation whatsoever regarding later use. In other words, if a concert is recorded and, at some point during the show, the cameras record a person in the audience, said person cannot demand compensation or claim limitations due to image rights.

Condition of venues and spectators' obligations
Venues cannot exercise right of entry and bar anyone from accessing the venue, except if the reasons given are against the Constitution or illegal in any way. Spectators must respect no access areas and prove their age by showing their DNI if required. The staff have the right to ask anyone they believe is underage to prove their age in certain shows.

With respect to the conditions of safety and comfort of the venue, the municipal authorities must ensure that the seating is built of safe materials, that the lighting, heating and ventilation are adequate and also provide anti-fire measures and visible fire extinguishers. The holder of an entrance ticket must be aware that the organiser can search him and his belongings to verify that the security conditions are met.

In addition, spectators are not allowed to smoke in areas where smoking is expressly banned. Weapons are also prohibited even if they are in order (with the exception of the Armed Forces and local police).

For their part, the organisers must guarantee the safety of the venue and also provide a book of complaints (the existence of which must by announced on the advertising posters), or several books of complaints .
